Climate Protection & Restoration Initiative is hosting a webinar on Friday, July 8th at 2pm to discuss the The US Supreme Court’s June 30, 2022 decision. The West Virginia v. EPA decision restricted select authority of the Environmental Protection Agency (EPA) to compel a reduction in Greenhouse Gas (GHG) emissions from power plants. In justification, the Court wielded its “major questions doctrine” to closely scrutinize what it deemed to be EPA’s patent attempt to exercise substantial control over the US energy market.

The Court thus appears to have narrowed the quantum of discretion it traditionally accords federal agencies when they interpret laws that Congress directed them to implement. What are the implications for CPR Initiative’s Petition to Phase Out GHG Pollution and Restore a Stable and Health Environment, or similar efforts?
